 FISO 4266 Presents this privacy notice in order to comply with articles 15, 16 and other related articles of the Federal Law on Protection of Personal Data Held by Private Parties (The Law).

FISO 4266 offers its clients advisory, supervision, and control products and services for all types of engineering and architecture projects or designs; buying and selling all kinds of construction materials; administration, buying and selling, and renting of all types of real estate, among others. Furthermore, it commits to treating this data under the strictest security measures to ensure its confidentiality.

The CLIENT authorizes FISO 4266 to process their personal data in accordance with the purposes described below, to use them during the development of the contracted operations and services. FISO 4266 will be responsible for protecting them while they are in its possession.

Personal data received from the client

The CLIENT expressly agrees to provide FISO 4266, for processing, the following personal data, including but not limited to:

a. General data of the holder: Last Name, Mother's Last Name, First Name(s), Date of Birth, Federal Taxpayer Registry (RFC), Gender, Nationality, Place of Birth, official identification, marital status, spouse's name, property regime, Unique Population Registry Code (CURP), profession, occupation, email address. In case of being a legal entity, articles of incorporation, RFC, proof of address, bank statements, INE (National Electoral Institute), and legal accreditation of the legal representative.

b. Address: Street, exterior number, interior number, neighborhood, zip code, State, delegation/municipality, telephone, email address.

SENSITIVE PERSONAL DATA. To fulfill the purposes set forth in this Privacy Notice, FISO 4266 informs that sensitive personal data may be collected and processed, including but not limited to:

a. Financial and Banking Data: Financial and banking data that may be requested include financial information, bank accounts, credit and debit card information, income and expenses, bank CLABE, RFC, references, and credit history.

b. Asset Data: Information about movable and immovable property. Express consent is required for the treatment of Financial and Banking Data, obtained through the signing of this privacy notice.

This data will be treated under the strictest security measures to ensure its confidentiality. Other personal, sensitive, and non-sensitive data may be processed, not included in the above lists, as long as such data are considered of the same nature and are not excessive regarding the purposes for which they are collected. Express consent is required for the treatment of Sensitive Personal Data, Financial and Banking Data, and Asset Data, obtained through the signing of this privacy notice.

Purpose of personal data

The CLIENT consents to their personal data being used by FISO 4266 for the PRIMARY PURPOSE of:\

  1. Identification, location, and contact with the owner.
  2. Generating intermediary contracts with the owner and/or developer.
  3. Carrying out the deed process.
  4. Generating purchase-sale, administration, or rental promise contracts, or any other preparatory contract or agreement required to be entered into between THE CLIENT and FISO 4266.
  5. Any other purposes necessary for the provision of the services requested by you.
  6. Issuing invoices and tax receipts.

Secondary Purposes

  1. Conducting internal studies and processes.
  2. Conducting quality surveys on service and customer attention.
  3. For marketing, advertising, or commercial prospecting purposes.
  4. Complying with applicable legal and regulatory requirements.

  6. Refusal to use your personal data for these purposes cannot be a reason for us to deny you the services and products you request or contract with us.

Security of Personal Data

In accordance with the provisions of the Political Constitution of the United Mexican States, within its article 16, as well as the provisions of the Federal Law on Protection of Personal Data Held by Private Parties, FISO 4266 will implement the necessary technical, administrative, and physical security measures to ensure the integrity of your personal data and prevent their damage, loss, alteration, destruction, or unauthorized use, access, or processing.

Only personnel authorized by FISO 4266 and designated as responsible for safeguarding your personal data may participate in the processing of your personal data. Authorized personnel are prohibited from allowing access by unauthorized persons and/or using personal data for purposes other than those established in this Privacy Notice. The confidentiality obligation of the individuals involved in the processing of your personal data remains even after the relationship with FISO 4266 has ended.

Transfers

The CLIENT understands and accepts that FISO 4266 may transfer their personal data to FISO 4266, and third parties contracted by FISO 4266 to perform certain tasks on its behalf and representation related to commercial activities, product, and service promotion, and in general with activities related to the corporate purpose of FISO 4266 such as third-party developers, financial or credit institutions, advertising companies, insurers, and collection agencies.

FISO 4266 hereby declares that it will transfer the information contained herein when necessary to the Ministry of Finance and Public Credit, legal firms, Credit Bureau; in such cases, FISO 4266 will ensure that these third parties provide the same treatment as stated herein. Third parties shall not have the authority to transmit the information or use it for purposes other than those designated by the owner through FISO 4266.

Your personal data may also be transmitted to Mexican Financial Authorities, in order to comply with applicable laws and official requirements, authorities and Institutions of the insurance and bonding sector to provide contracted services, as well as compliance with regulations on money laundering prevention, providing in this case the indispensable data; also to the competent local and federal authorities when within the exceptions provided in the Law and its Regulation. In the case of transfers, processing of your sensitive, financial, and banking personal data, express consent will be required through the signing of this privacy notice.

The transmission of personal data indicated in the previous paragraph includes the disclosure of information in a confidential database to third parties that may be participating in a project or business transaction with FISO 4266, including implementation of systems, financing, insurance, or, where appropriate, assignment of rights, debt collection, socioeconomic studies, among others.

FISO 4266 may freely transmit the CLIENT'S personal data to controlling, subsidiary, or affiliate companies, to a parent company, or to any company of FISO 4266 operating under the same internal processes and policies.

Limitations on Information Disclosure

FISO 4266 undertakes not to transfer your personal information to third parties other than those mentioned in the preceding paragraph without your consent. If the CLIENT has consented to transfers, FISO 4266 will inform the CLIENT, through printed or electronic means, of the purpose for which such information will be transferred to third parties; likewise, FISO 4266 will inform, through the same means by which the personal data were collected (physical address and email address), of any changes made to the privacy notice.

Likewise, the CLIENT undertakes to notify FISO 4266 of any changes regarding their physical address and/or email address, so that FISO 4266 can communicate with the CLIENT to inform any changes or modifications regarding the content of this privacy notice. FISO 4266 will not need the CLIENT'S consent to transfer their information to third parties in the following cases:

  1. When the transfer is provided for in a Law or Treaty in which Mexico is a party.
  2. When the transfer is necessary for the prevention or medical diagnosis, the provision of health care, medical treatment, or the management of health services.
  3. When required by competent authorities in accordance with applicable legal provisions.

Mechanisms to exercise rights of access, rectification, cancellation, and objection (arco) of Personal Data

You have the right to: (i) access your personal data in our possession and know the details of their treatment, (ii) rectify them if they are inaccurate or incomplete, (iii) cancel them when you consider that they are not necessary for any of the purposes indicated in this Privacy Notice, they are being used for unauthorized purposes, or the contractual or service relationship has ended, or (iv) object to the processing of them for specific purposes, as provided by law (together, the "ARCO Rights").

The ARCO Rights will be exercised by submitting the respective request, which can be requested from the Privacy Officer at the above-mentioned email address, naming the email as the "ARCO Request", which will be sent to the Privacy Officer at the Contact Address, accompanied by the following information and documentation:

  1. Your name, address, and email address to communicate the response to the ARCO Request;
  2. Documents proving your identity (copy of INE, passport, or any other official identification) or, if applicable, documents proving your legal representation;
  3. A clear and precise description of the personal data for which you intend to exercise any of the ARCO Rights;
  4. Any document or information facilitating the location of your personal data;
  5. In case of requesting a rectification of data, you must also indicate the modifications to be made and provide the documentation supporting your request;

Your ARCO Request will be answered by email by the Privacy Officer within a maximum period of 20 (twenty) business days counted from the day the ARCO Request was received. In case the ARCO Request is answered affirmatively or appropriately, such changes will be made within a maximum period of 15 (fifteen) business days. The deadlines referred to in this paragraph may be extended once for an equal period if necessary.

It is important to inform you that FISO 4266 may deny access (the "Denial") to exercise your ARCO Rights in the following cases:

  1. When you are not the owner of the personal data, or your legal representative is not duly accredited to exercise your ARCO Rights on your behalf;
  2. When your personal data are not found in our database;
  3. When the rights of a third party are violated;
  4. When there is a legal impediment or a resolution of a competent authority that restricts your ARCO Rights; and
  5. When Rectification, Cancellation, or Objection has been previously carried out.

In relation to the above, the Denial may be partial, in which case FISO 4266 will carry out access, rectification, cancellation, or objection in the relevant part.

FISO 4266 will always inform you of the reason for its decision and will communicate it to you or, if applicable, to your legal representative, within the previously established deadlines, by email, accompanying, if applicable, the relevant evidence.

The exercise of the ARCO Rights will be free of charge, upon accreditation of your identity before the controller, but if you repeat your request within a period of less than twelve months, the costs will be three days of the General Minimum Wage in force in the Federal District, plus VAT, unless there are substantial modifications to the Privacy Notice that warrant new consultations. In all cases, the delivery of personal data will be free of charge, except that you must cover the justified expenses of shipping or the cost of reproduction in copies or other formats.

The CLIENT may revoke the consent granted to FISO 4266 for the processing of personal data that are not essential for the fulfillment of the obligations arising from the legal relationship that binds them, so that FISO 4266 ceases to use them. To do so, it is necessary for the CLIENT to submit his request in the aforementioned terms.

Mechanism for Revocation of Consent.
